Coaching & Consulting Terms & Conditions
The coaching and consultation services provided by Jason Ayers and Visionary Alignment are intended to support personal and professional growth and development.
Not a Substitute for Licensed Therapy, Professional Mental Health Care, or Medical Care
Please be informed that Jason Ayers is not a licensed therapist, psychologist, or psychiatrist. The services offered are not intended to diagnose, treat, cure, or prevent any mental health or psychiatric conditions. The coaching provided should not be construed as a substitute for therapy or professional mental health services.
It is solely your responsibility to seek and follow appropriate medical advice from a licensed healthcare professional. If at any time, Jason Ayers and/or Visionary Alignment deem(s) it appropriate, you may be recommended or referred to seek professional therapy or counseling.
Your acceptance of these terms and your decision to engage in coaching or consultation services with Jason Ayers and/or Visionary Alignment indicates that you understand and agree to the above disclaimer.
By entering into a coaching or consultation relationship with Jason Ayers and/or Visionary Alignment, you acknowledge that you do so with full understanding of this disclaimer.
Always consult with your healthcare provider before making any changes to your treatment regimen.
Confidentiality and Duty of Care
The coaching and consultation sessions conducted by Jason Ayers and/or Visionary Alignment are conducted in a confidential environment, where information discussed will not be disclosed without your written consent, except as required by law or ethical duty. Be advised that sessions are recorded and transcribed for quality assurance purposes.
Please be aware, however, that in the interest of your safety and the safety of others, if you communicate an intent to cause harm to yourself or others during our sessions, Jason Ayers and/or Visionary Alignment reserve(s) the right to disclose this information to any and all relevant authorities, healthcare providers, or other individuals who can assist in preventing the potential harm. This disclosure may occur without your prior consent in circumstances where there is a clear risk of danger.
Your initiation and continuation of coaching or consultation services with Jason Ayers and/or Visionary Alignment indicate your understanding and acceptance of this duty of care and the limits to confidentiality outlined above.
Intellectual Property
Any and all intellectual property rights, including but not limited to coaching materials, methodologies, and techniques used during your coaching sessions with Jason Ayers and/or Visionary Alignment remain the sole property of Jason Ayers and/or Visionary Alignment. These materials are provided for your personal use only and must not be copied, published, or distributed without the express written permission of Jason Ayers and/or Visionary Alignment.
Cancellation and Refund Policy
Appointments must be cancelled or rescheduled at least 24 hours in advance to avoid a cancellation fee of 50% of the coaching session cost. Refunds for prepaid coaching sessions or packages are not available. If you are not committed, don't sign up at this time.
Communication Between Sessions
Communication between scheduled sessions can occur by text message. Jason Ayers and/or Visionary Alignment aims to respond to all text messages within 48 hours. Please note that any situation or crisis that requires immediate attention should be directed to your local mental health crisis services.
Limitations of Liability
In no event will Jason Ayers and/or Visionary Alignment be liable to you for any indirect, consequential, exemplary, incidental, special, or punitive damages arising from or relating to your use of our services. You accept full responsibility for the consequences of your use, or non-use, of any information provided, and you agree to use your judgment and due diligence before implementing any idea, suggestion, or recommendation from Jason Ayers and/or Visionary Alignment.
Results may vary, as with any program or product, you could be more or less successful or not successful at all. Success in ANY endeavor is a result of hard work, dedication, timing, thoughtfulness, and a variety of other factors.
Indemnification
You agree to indemnify, defend, and hold harmless Jason Ayers, Visionary Alignment, and their respective agents, employees, successors, and assigns, from and against any and all claims, liabilities, damages, losses, costs, expenses, fees (including reasonable attorneys' fees), and penalties arising out of or related to your use of the coaching and consultation services provided by Jason Ayers and Visionary Alignment, including but not limited to any claims or actions based on personal injury, property damage, negligence, or breach of contract. This indemnification obligation shall survive the termination or expiration of the coaching or consultation relationship.
Dispute Resolution
Any dispute or claim arising out of or relating to these terms and conditions will be settled by mediation to be conducted in Maricopa County, Arizona, and if necessary, legally binding arbitration in accordance with the rules of the American Arbitration Association.
Severability
If any part of these Terms of Use and Service is unlawful, void, or unenforceable, that part shall be deemed severable and shall not affect the validity and enforceability of any remaining provisions
Confirmation of Understanding
By engaging the services of Jason Ayers and/or Visionary Alignment, you confirm that you have read, understood, and agree to these terms and conditions as presented by Jason Ayers and/or Visionary Alignment.
